Terms & Conditions

1. Payment Terms

1.1 Payment Schedule

The Client agrees to pay in accordance with the agreed quotation and/or payment schedule. This may include:

  • Upfront payment for materials prior to commencement

  • Interim or milestone payments for larger projects

  • Final balance due immediately upon practical completion

1.2 Payment Methods

Payments may be made via bank transfer, cash, or card. The Client is responsible for any applicable transaction fees.

1.3 Late Payments

McKee Joinery reserves the right to charge interest and reasonable recovery costs on overdue payments in accordance with applicable legislation.

1.4 Title to Materials

Materials supplied remain the property of McKee Joinery until payment is received in full.Where materials have been installed or fixed to the property, ownership transfers upon installation and any outstanding sums remain recoverable as a debt.

2. Workmanship Guarantee

2.1 Standard of Work

All works will be carried out with reasonable skill and care, in line with recognised industry standards.

2.2 Defects Liability Period

Any defects relating to workmanship should be reported within 14 days of completion to allow prompt resolution.This does not affect the Client’s statutory rights.

2.3 Exclusions

This guarantee does not cover:

  • General wear and tear

  • Natural movement in materials (e.g. timber shrinkage or expansion)

  • Damage caused by misuse, lack of maintenance, or third parties

  • Works altered or repaired by others after completion

2.4 Third-Party Interference

No liability is accepted for defects arising where works have been modified, altered, or interfered with by the Client or third parties.

2.5 Payment Condition

All guarantees are conditional upon full payment of all invoices in line with the agreed payment schedule.

3. Materials

3.1 Quality of Materials

All materials supplied by McKee Joinery will be of suitable quality and fit for purpose.

3.2 Manufacturer Warranties

Any applicable manufacturer warranties shall be passed to the Client upon full payment. Assistance with claims may be provided where reasonable.

No responsibility is accepted for the performance or suitability of client-supplied materials unless an issue arises directly from installation workmanship.

3.3 Client-Supplied Materials

3.4 Liability Limitation

Liability for defective materials will be addressed in line with manufacturer warranty terms and applicable consumer legislation.

3.5 Payment Condition

Material-related guarantees are valid only once all invoices have been settled in full.

4. Variations & Additional Work

Any additional works or changes to the agreed scope must be:

  • Agreed in advance

  • Confirmed in writing where possible

  • Subject to revised costs and timescales

No additional work will be undertaken without Client approval.

5. Access & Working Conditions

The Client must provide safe, clear, and reasonable access to the work area.
Delays or additional costs arising from restricted access, unsuitable conditions, or inability to proceed may be chargeable.

6. Delays

McKee Joinery shall not be held liable for delays caused by factors beyond reasonable control, including but not limited to:

  • Adverse weather

  • Material shortages

  • Restricted or unsafe access

  • Unforeseen site conditions

  • Illness or emergency

McKee Joinery shall be entitled to a reasonable extension of time in such circumstances.

7. Insurance

McKee Joinery maintains appropriate insurance cover, including:

  • Public Liability Insurance

  • Employers’ Liability Insurance (where applicable)

Proof of insurance can be provided upon request.

8. Termination

8.1 Termination for Breach

Either party may terminate the agreement in writing where there is a material breach, subject to reasonable notice.

8.2 Payment on Termination

In the event of termination, the Client shall pay for:

  • All work completed up to the termination date

  • Materials purchased or ordered

  • Any reasonable and demonstrable costs incurred as a direct result of termination

Works shall be deemed complete upon practical completion.
Final payment is due at this stage and prior to handover.

10. Dispute Resolution

Both parties agree to make reasonable efforts to resolve any dispute amicably.
Where resolution cannot be reached, mediation may be considered prior to legal proceedings.

11. Compliance with Laws

All works will be carried out in accordance with:

  • Relevant UK and Scottish legislation

  • Applicable building regulations

  • Health & Safety requirements

12. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Scotland.

13. Photography & Marketing

McKee Joinery reserves the right to:

  • Take photographs/videos during and after completion of works

  • Use images for portfolio, website, and marketing purposes

No identifiable personal information will be used without consent.
Clients may opt out by confirming in writing prior to commencement.

14. Entire Agreement

These Terms & Conditions, together with the quotation and scope of works, constitute the entire agreement between both parties and supersede any prior discussions or agreements.

15. Amendments

McKee Joinery reserves the right to update these Terms & Conditions where necessary to reflect:

  • Legal requirements

  • Operational improvements

  • Market conditions

The applicable version will be the one issued at the time of quotation.
